General terms and conditions of sale of JO's Jewelry website

Preamble - General and terminology

The present General Terms and Conditions of JO'S Jewelry and use of its website www.joaillerie-jos.com define the rights and obligations between:

On the one hand, JO'S JEWELERY, teaches the SARL "JO'S", registered in the Trade and Companies Register of Créteil under the number of SIRET 483 341 723 00011 (code APE 4777Z), whose VAT number intra-community is FR20441516002 and the registered office located at 4, Rue Saint Honoré Market 75001 PARIS, acting in the context of its distance selling of products and services, on its website www.joaillerie-jos.com (hereinafter referred to "We", "Our", "Our", "JO'S Company", "JO'S Jewelry" or "JO'S");

and on the other hand, any natural person acting solely for his personal needs (hereinafter referred to as "You", "Your", "Your", the "user" or the "user"), who consult the website www.joaillerie-jos.com and / or make a purchase there.

The client user of the website www.joaillerie-jos.com declares to have read and accept the rights and obligations contained therein and resulting therefrom.

The services offered by JO'S Jewelry on its website, namely the online sale of products, will be hereinafter referred to as the "JO's Jewelry Services" or "our services".

Each order made by a customer under the conditions provided below will be referred to as "the order".

Article 1 - Description of the products

The information mentioned on each product sheet, are those communicated to JO'S Jewelry by its suppliers. They are only given as an indication.
JO'S Jewelry undertakes to make the best efforts to correct errors or omissions as quickly as possible, as soon as they have been informed.
The photos, made by the care of JO'S Jewelry and those provided by the brands, are not contractual.

Article 2 - Customized creation

In the case of tailor-made jewelry creations, JO'S informs its customers that it can not in any case make an existing copy of jewelry made by other creator and / or brand and subject to the laws of property and trade inherent in this jewel.
For a jewel not to be considered a copy it must have a minimum of seven differences visible to the naked eye compared to the original jewel.
Although JO'S jewelry will do its best to ensure that any request for custom-made creation is not considered a copy, the client must inform JO'S jewelry of any possible similarities with other creations and provide maximum detail (reference and / or visual) so that JO'S can propose realizations as close as possible to the customer's expectations within a legal framework of creation.
The company JO'S reserves the right to refuse any creation that it judges not to respect the legal framework of creation.
In case of dispute the responsibility of the company JO'S can not be engaged.

Article 3 - Terms of order and price

Customers have the opportunity to place their order in different ways:

- On the Internet: www.joaillerie-jos.com 24h / 24h 7d / 7d

- By telephone, from Monday to Thursday from 10:00 to 18:00 and Friday from 10:00 to 17:00 at 01.42.60.07.23 (local call rate from a France Telecom fixed line).

- In store, from Monday to Thursday from 10:00 to 18:00 and Friday from 10:00 to 17:00 at 4 rue du Marché Saint Honoré 75001 PARIS.

Customers guarantee that they are fully entitled to use their credit card and that this credit card gives access to sufficient funds to cover all costs resulting from the use of JO'S Jewelry Services.
Only people legally able to take out contracts for the goods and services offered can order on the site www.joaillerie-jos.com .
The data provided by the customers and recorded by JO'S Jewelry on its website constitutes the proof of all the transactions made between JO'S Jewelry and its customers.
Jo's Joaillerie systematically confirms its customers' order and shipment by e-mail.
Contractual information is presented in French and will be the subject of a confirmation containing the said information at the latest at the time of delivery.
The prices of products for sale on the website www.joaillerie-jos.com are indicated all taxes included.
For deliveries and services outside France, the provisions of the General Tax Code relating to VAT apply.
JO'S Jewelry reserves the right to change prices at any time; however, the products will be billed based on the rates in effect at the time of order registration (subject to availability).
Jo's Jewelery reserves the right to refuse any order from a customer with whom there is a dispute.

Article 4 - Availability

JO'S Jewelry implements the best means to handle all orders in the shortest time possible.

In case of unavailability of the product after placing the order, the customer will be informed by email or phone the delivery of a partial order or the cancellation of his order.

If the debit has already occurred at the time of the information given on the unavailability of the product, a request for reimbursement of the amounts incurred is made: an email is then sent to the customer, indicating the procedure to follow.

As a result of this request, the speed with which the bank account is credited depends on the type of credit card of the customer.

To ensure repayment and delays, it will be recommended that the customer contact his bank.

Article 5 - Payment

The payment of purchases is made either by credit card (direct secure payment), or by the process of settlement "Sofinco" (from 3 to 20 times without expenses), by check, by transfer, or in cash directly to shops "Joaillerie JO'S": 4, rue du marché Saint Honoré 75001 PARIS.
Bank cards accepted as a method of payment on the site www.joaillerie-jos.com are: CB, Visa, Eurocard, Master Card.
The order will be considered effective after confirmation of the agreement of the customer's bank payment center.
If the bank refuses, the order will be automatically canceled and the customer will be notified by sending an email.
For a credit request, the agreement is given to you immediately by our partner Sofinco, but it implies to return to him a credit file accompanied by justifying documents before Joaillerie JO'S is authorized to deliver the order.
 

5.1 - Specific Terms of Payment

By credit card :
Payment is made on the secure banking server of our partner CIC, protected by the 3D Secure and Fia-Net Certissim system.


By check:
The customer's order is reserved for 7 days. Beyond this deadline, without receiving a check from the client, it will be canceled.
The order will only be processed upon receipt of the customer's check and after validation of the receipt.

Wire Transfer :
The customer's order is reserved for 7 days. Beyond this period, without receiving the transfer from the customer, it will be canceled.
The order will only be processed upon receipt of the customer's transfer.

Cash :
The customer can settle his order in cash by going directly to stores (Monday to Thursday from 10:00 to 18:00 and Friday from 10:00 to 17:00, without appointment) 4 rue du marché Saint Honore 75001 PARIS.

5.2 - Retention of title clause

The products remain the property of JO'S Jewelery until the complete collection of the order.
However, upon receipt of the order by the customer, the risks relating to the delivered goods are transferred to the customer.

5.3 - Default of Payment

JO'S Jewelry reserves the right to refuse to make a delivery or to honor an order from a customer who has not totally or partially paid a previous order, or with whom a payment dispute is in progress.

Article 6 - Security

The site www.joaillerie-jos.com is equipped with one of the most powerful security systems at the moment.
The customer's credit card details are encrypted using the SSL (Secure Socket Layer) protocol and never transit in the clear over the network.
Payment is made directly to JO'S jewelery bank: the CIC.
Jo's Jewelery has no access to these coordinates, and does not keep them on its servers.
That's why they are asked again to the customer with each new transaction on the site www.joaillerie-jos.com .
The rules governing the use of bank cards require banks domiciled in France to cover the risk of fraudulent use of their customers' credit cards.
JO'S Jewelery reminds its customers that they must notify any fraudulent transaction to their bank or institution issuing their credit card.

Article 7 - Anti Fraud Checks

JO'S Jewelry, in collaboration with Certissim of FIA-NET, controls all orders that have been validated on its website.
These controls are designed to protect JO'S Jewelry from abusive practices by fraudsters.
For an order that has a delivery address different from the billing address, JO'S Jewelry may be required to contact the two persons mentioned; namely the person attached to the billing address and the person indicated for the delivery address.
As part of these procedures, JO'S Jewelry may be asked to ask its customers all the necessary parts to release their order: proof of residence and debit in their name, a proof of address in the name of the person indicated for the delivery address, and any other proof that can guarantee the authenticity and regularity of the order.
These requests are made by email, and if necessary by registered mail with acknowledgment of receipt.
The information related to your order is subject to an automated data processing whose responsible is FIA-NET SA This automated data processing has the purpose of defining a level of analysis of a transaction and to fight against credit card fraud.
FIA-NET SA and the merchant from whom you make your purchase are the recipients of the data related to your order. The non-transmission of data related to your order prevents the realization and analysis of your transaction.

Shipping costs are free beyond 300 euros of purchase all taxes included.

Below a fixed price is applied according to three zones:

Article 9 - Delivery

The vast majority of items that JO'S Jewelry offers on its website are in stock in its store and can be shipped the day of the order.

JO'S Jewelery guarantees it for any order placed on working days before noon.

Orders placed beyond are processed, at the latest, the morning of the next business day.

For products that are not in stock, they may be either non-storable particular products or products temporarily unavailable due to the high demand that may affect them on our site punctually: the availability of these products implies a delay. obtaining or restocking for 8 to 10 days; this period is specified on the detailed sheet of these products.
Whatever the carrier and / or the mode of sending, it will necessarily be issued by registered mail with acknowledgment of receipt.
 

9.1 - La Poste (Declared Value Package):

Shipments are systematically carried out in Declared Value for any order whose amount is greater than 1500 €.

On request they can always be shipped in Declared Value for any order whose amount is between 600 and 1500 €.

For any shipping request in Declared Value for a total order amount of less than 300 € the customer must necessarily contact JO'S Jewelry.

The products will be sent to the delivery address that the customer has indicated during the ordering process.
The customer must choose the place of delivery: at home, at the office, at a third party, at his place of holidays ... except postal boxes.
All deliveries of JO'S Jewelry are announced by email.
When shipping a complete order, JO'S Jewelery warns the customer that an original invoice is available online.
In the case of a partial shipment, a purchase order, available online, summarizing the products actually present in the package is attached to it.
Jo's Jewelery delivers orders throughout metropolitan France (including Monaco Andorra and Corsica).

The email informing the customer of the departure of his package includes a tracking number.

The customer can follow the routing of his order on the website of La Poste, at the URL: http://www.laposte.fr/csuivi

In the event of absence during the delivery, to the address indicated by the customer, a notice of passage is normally deposited in the mailbox: it is then possible for him to withdraw the parcel in his post office within 10 days following the filing of this notice.

If this period is exceeded, the package is then returned to JO'S Jewelry.

For any order to a country other than France, the customer is considered as the importer of the product (s) ordered (s). For all products shipped outside the European Union, the price will be calculated excluding taxes automatically on the invoice. Customs duties, other local taxes, import duties or state taxes may be payable. These rights and sums are not the responsibility of JO'S Jewelry and are not under its responsibility. They will be entirely the responsibility of the customer and under his responsibility, both in terms of declarations and payments to the authorities and / or competent bodies. JO'S Jewelery invites its customers outside mainland France to inquire with the competent authorities of their country of residence.

For purchases over 10,000 €, JO'S Jewelry invites its customers to contact its services in order to consider either a split of the shipment in several packages, or a personalized transport.

9.2 - Carrier:

In the case where the package would be delivered by carrier, a notice is also left in the mailbox of the customer in case of absence thereof. It will then be up to the customer to contact the carrier to agree on a new delivery date.
In order to optimize the delivery, we thank the customer to mention an address to which the order can be delivered during business hours.
The delivery time is fixed at 3 working days after the validation of the order, except for the particular orders and the customizations of a product.
The delivery time will then be available on the "Order Tracking" on the JO'S Jewelry website.
Unless otherwise stipulated, the products are delivered within the times indicated above, when the order is placed.

In case of exceeding the deadline, the customer may cancel the order and be refunded the full amount paid (amount of purchases and any shipping costs).
However, if this delay is caused by a case of force majeure while the product is being transported, JO'S Jewelry will inform the customer by e-mail that his request for cancellation can not succeed.
The customer may then cancel his order after the delivery of the order under the conditions provided for in Article 10 of these Terms and Conditions.
Delivery times are average times corresponding to the processing and transport times.
These delays also vary by destination and do not include holidays and weekends.
Each delivery is considered made from the provision of the product to the customer by the carrier, materialized by the control system used by the carrier.
It is the responsibility of the recipient to check the shipments on arrival and make all reservations and claims that would appear justified, or even refuse the package, if it is likely to have been opened or if it bears clear traces of deterioration.
The said reservations and complaints must be sent to the carrier by registered letter with acknowledgment of receipt within three working days after the delivery of the products, a copy will be sent immediately to JO'S Jewelry.
If a damaged parcel has been deposited in the client's mailbox or if the guardian or a third party has received it, the parcel is considered as "accepted as is".
If no reserve has been issued at the time of delivery, JO'S Jewelry will not be able to take into account any possible disappearances or deteriorations, or to make any compensation.
If the delivered products do not comply in kind, quantity or quality with respect to the specifications indicated in the delivery note, the customer will have to formulate his claims within a period of 30 days from the date of delivery.
After this period, the customer will no longer be entitled to claim compensation.

9.3 - La Poste (Colissimo followed and recommended international):

All our shipments are made in Colissimo followed for any order whose amount is less than 1500 €.

The products will be sent to the delivery address that the customer has indicated during the ordering process.

Article 10: Treatment of parcels not distributed by the service provider

Concerning the orders which have not been delivered to the final recipient for the following reasons: NPAI, unclaimed, refused, damage of transport, spoliation ...
 

10.1 Terminology:

- NPAI: parcels returned by the provider responsible for delivery under the mention: N'habite Pas à l'Adresse Indiquée,

- Unclaimed: parcels that have not been claimed by the customer at his post office or carrier within the time limits,

- Refused: package refused by the customer at the time of delivery,

- Transport damage: parcel is damaged, torn, open ...

- Spoliation: parcels that have not been delivered to the client due to spoliation: open parcels, shock marks, empty parcels ...

- Reference error: the product received is not the product ordered by mistake of reference, problem of size, color, characteristics, obviously different product ...

Warning: The verification of the condition of the product (s) is considered to have been made once the delivery note has been signed. The terms "subject to" or "subject to unpacking" do not constitute qualified reserves and have no legal value.
It is essential that the customer accurately describe the condition of the packaging and / or the product. (Ex: noise of breakage, open package, damaged packaging, torn, depressed, empty package ...).
It is also necessary to keep the damaged packaging for possible expertise by the carrier, and at the slightest doubt it may also be useful to take photographs at the opening.
The customer has a period of 3 working days following receipt of his order to protest to the carrier or to request an expertise (Articles L.133-3 and L133-4 of the Code of Commerce).

10.2 Processing returns

After receipt and acceptance of the parcel by our services, depending on the nature of the product, available stocks and according to the wishes of the customer, JO'S Jewelry will propose to reship the product initially ordered.

Otherwise, or in case of refusal of the customer, a voucher will be credited to the customer's account within 2 business days of receipt of the package.

If the customer requests to be refunded, a check of the product amount and any shipping costs will be sent within 15 days of acceptance of the return.

If a voucher is issued, the customer can request at any time the cancellation of it and its refund by check:
- Directly on the personalized customer area accessible on the site www.joaillerie-jos.com,

- By telephone at 01.42.60.07.23 (local call rate from a France Telecom fixed line).

- By simple mail (however, for more security, JO'S Jewelery advises its customers to proceed by mail with Acknowledgment of Reception) to the following address: Joaillerie JO'S - Customer Service - 4 rue du marché Saint Honore 75001 PARIS.

The check will be sent to the customer within 15 days of the request.

10.3 Special provisions:

- Transport damage and / or spoliation:

If the package is damaged, torn, opened ... the customer must refuse the package and contact the customer service of JO'S Jewelry.
If the provider responsible for the delivery of your package is the Post Office, the customer must request a declaration of spoliation at the time of refusal.
In case of damage or spoliation, the customer must make reservations characterized on the delivery note.
The customer must also confirm these reservations by registered mail to the carrier no later than 3 working days after receipt of the item (s), and send a copy of this letter to: Joaillerie JO'S - Return service - 4 rue du marché Saint Honoré 75001 PARIS, recalling the references shown on the delivery note.

- Reference error:

The customer has 30 days to report to JO'S Jewelry that the product received is not the product ordered: reference error, size problem, color, characteristics, obviously different product ...

Terms of return

The product must be returned in good condition and in its original packaging, even if it has been opened, with all its contents (accessories, cords, box, certificate ...).

In order to correctly process the requests of its customers, they must remember their order number and full contact details.
It will not be possible to pick up all parcels for which there is nothing to identify the sender (surname, first name, address, order number).

Article 11 - Lost Package

When a parcel leaves the Jo's Joaillerie's warehouses, it is sent by La Poste (in Declared Value) and, in exceptional cases, at the request of the customer or on a proposal from JO'S Jewelry, by private carrier (see Article 7 - Delivery ).
 

11.1 In the case of a shipment by the Post Office declared value.

If 5 working days after the dispatch of the parcel, the customer has no news of his order, he must get closer to the post office closest to the place of delivery indicated on the parcel.

- If the package is found, it is then sent to the customer and the receipt procedure then follows its normal course (deposit package or notice, etc. ...)

- If the package is declared lost (as a result of unsuccessful searches by La Poste within 3 weeks), JO'S Jewelry then notifies the customer and immediately initiates the procedure for reimbursement of the order.

The amount guaranteed by the insurer of SARL JO'S (Cabinet Ebrard - ZAC de la Plaine - 5, impasse Rene Couzinet - BP 75807 - 31505 Toulouse Cedex) for its remittances in distance selling is 30.000 €.

Up to 30,000 €, regardless of the amount of products purchased by the customer on the site www.joaillerie-jos.com, the total amount is guaranteed, but the amount shown on the bill of lading value of the Post may be lower the actual amount of its content.

11.2 In the case of a shipment by carrier.

The customer is informed of the departure of his order by sending an email summarizing his order.

The package is then forwarded within 1 to 3 business days.
In the event of absence, a notice of passage is deposited in the mailbox: the coordinates of the carrier are then communicated to the customer who must then arrange an appointment by calling the number indicated on the notice.

If the carrier can not leave a notice of passage (address unknown, code door not communicated ...), it contacts Joaillerie JO'S to obtain details on the coordinates of the customer.

Without a reply from the latter, the parcel is sent back to the JO'S Jewelry Returns Department and the reimbursement procedure is then initiated.

Article 12 - Retraction and 30-day guarantee

- Legal withdrawal period:

In accordance with the Consumer Code, article L121-20-12, every consumer has a period of fourteen calendar days to exercise his right of withdrawal, and this is valid for any purchase made on the Internet.

Prior to any return, the customer will have to indicate his intention by means of the form of contact, on the site www.joaillerie-jos.com or by e-mail with contact@joaillerie-jos.com

This right of withdrawal can not be exercised for products made according to customer specifications or clearly personalized (Article L121-20-2 of the Consumer Code).

Unless otherwise specified by JO'S Jewelry, the return will be made to the following address:

JO'S Jewelry - Returns Department - 4 rue du marché Saint Honoré 75001 PARIS.
The customer exercises his right of withdrawal in accordance with Article L 121-20 of the Consumer Code within 14 days of receipt of the goods.

This right is exercised by returning the product to JO'S Jewelry, only the cost of return being borne by the customer. The refund covers all the sums paid: price of the product or products and any shipping costs.

The refund from the customer's bank will be made within 30 days from the receipt of the goods by JO'S Jewelry, following the exercise of the right of withdrawal.

The right of withdrawal is also exercised upon order and before delivery. In this case, a refund from the customer's bank is made within 30 days from the exercise of the right of withdrawal.

Following this request, the speed with which the bank account is credited depends on the type of credit card of the customer.

If the right of withdrawal is exercised between the date of departure of the products of JO'S jewelry shops and the delivery of the goods to the customer, the delivery costs will be borne by the customer.
This right of retraction can not be exercised if the delivered products have obviously been the object of a durable use.

The products must imperatively be returned properly protected, in their original packaging, in a perfect state of resale (not damaged, damaged, soiled, scratched ...), accompanied by any accessory (case, certificate ...).

It will not be possible to pick up all parcels for which there is nothing to identify the sender (surname, first name, address, order number).

The costs and risks related to the return of the product are the responsibility of the sender.

The return of products will result in a refund equal to the purchase price of the product (s) purchased (s), and any delivery costs.

Upon processing the return, JO'S Jewelry sends an email informing of the delay and the amount of the refund.

No return of product sent in "against refund" will be accepted, whatever the reason.

- JO'S 30-Day Jewelery Guarantee

In order to secure purchases by its customers on its website, JO'S Jewelry gives them a period of 30 days after receiving their order to retract.

This right of retraction can not be exercised if the delivered products have obviously been the object of a durable use.

The products must imperatively be returned properly protected, in their original packaging, in a perfect state of resale (not damaged, damaged, soiled or scratched ...), accompanied by any possible accessories (box, certificate, warranty certificate ...).

It will not be possible to pick up all parcels for which there is nothing to identify the sender (surname, first name, address, order number).

The costs and risks related to the return of the product are the responsibility of the sender.

The return of the products beyond the period of 14 days and within the 30 day period will result in a refund equal to the purchase price of the product (s) purchased, excluding possible delivery charges.

This 30-day guarantee can not be exercised for products made to customer specifications or clearly personalized (Article L121-20-2 of the Consumer Code).

Article 13 - Guarantee

In case of products that do not comply with the information given during the presentation of the products on the site, they will be replaced or refunded according to the availability of similar products and the will of the customer.

Reimbursement or delivery of new products will take place within 30 days of receipt of non-compliant products or products with hidden defects.
As a result of this request, the speed with which the customer's bank account is credited depends on the type of customer's credit card.

Jo's Jewelery guarantees that the products it presents for sale on the site www.joaillerie-jos.com are free from defects, or hidden defects that could make them dangerous or unsuitable for their normal use.
The contractual warranty granted by JO'S is a lifetime guarantee on all its creations, tailor-made creations and branded products distributed by JO'S.

Any guarantee is excluded in the event of defects and deteriorations resulting from external events, accidents, wear ... and use outside the framework defined by the characteristics of the product. Any product without sealing specification is considered unsealed.

The provisions of this article shall not preclude the legal warranty for hidden defects, as defined in Articles 1641 and following of the Civil Code, when the product is sold to a consumer or a non-professional.

Only products with proven hidden defects may be returned under this condition.
According to this article, the customer who declares that his product suffers from a hidden defect must prove it.

Thus, an expertise of the product must be requested by the customer from a mandated expert so that it certifies the hidden defect.

If the expertise confirms that there is a hidden defect, the authentic document must be sent to our customer service as soon as possible.
JO'S Jewelry - Returns Department - 4 rue du marché Saint Honoré 75001 PARIS.

Upon receipt of the document, a return agreement number and the procedure to be followed to return the product (s) is communicated to the customer by JO'S Jewelry.
